Welcome to Albumy. These Terms of Service ("Terms") govern your access to and use of Albumy's professional photography platform at albumy.pro and related services (collectively, the "Services"). By using our Services, you agree to these Terms.
1. Acceptance of Terms
By accessing or using Albumy, you agree to be bound by these Terms and our Privacy Policy. If you're using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms. If you don't agree to these Terms, you may not use our Services.
2. Description of Service
Photography-Only Platform
Albumy is exclusively for professional photographers and their clients. Only photographer-shot images, videos, and related content may be stored. General file storage or non-photography content is prohibited.
Albumy provides:
- Secure cloud storage with enterprise-grade infrastructure
- Professional gallery creation and client sharing
- Client proofing, selection, and approval workflows
- 4K video hosting and delivery
- AI-powered face recognition and organization
- Custom branding and white-label options
- Real-time collaboration tools
3. Account Registration
3.1 Eligibility
You must be at least 18 years old to create an account. Accounts must be used for legitimate professional photography purposes.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use. We recommend enabling two-factor authentication.
3.3 Accurate Information
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
4. Subscription Plans and Fair Use
Fair Use Policy: 5TB per Year
Our unlimited plans include a fair use limit of 5TB of uploads per year, designed to accommodate most professional photography workflows while ensuring optimal performance for all users.
4.1 Plan Structure
- Free Plan: 25GB storage, limited features
- Starter Plan: $15/month, expanded storage and features
- Pro Plans: Unlimited storage (5TB/year fair use), full features
4.2 Fair Use Guidelines
- Annual upload limit of 5TB for unlimited plans
- Usage alerts at 75%, 90%, and 95% of limit
- Proactive support for optimization if approaching limits
- Custom enterprise solutions available for higher volume needs
4.3 Billing
Paid subscriptions are billed in advance on a monthly or annual basis. Subscriptions automatically renew unless cancelled before the renewal date. All payments are processed securely through Stripe.
5. Free Trial
We offer a 4-month free trial for new users. During the trial, you have access to Pro features with 25GB storage. At the end of the trial, you may subscribe to a paid plan or continue with the free plan (subject to storage limits). Content exceeding free plan limits may be deleted if you don't upgrade.
6. Refund Policy
We offer a 30-day money-back guarantee for new paid subscriptions. If you're not satisfied within 30 days of your initial purchase, contact us for a full refund. This guarantee does not apply to renewals or users who previously received a refund.
7. Your Content
You Own Your Work
You retain complete ownership and all intellectual property rights to your photographs, videos, and creative content. Albumy never claims ownership of your work.
7.1 License to Albumy
By uploading content, you grant Albumy a limited, non-exclusive license to store, process, and deliver your content solely for providing our Services. This includes creating thumbnails, optimized previews, and enabling gallery sharing. We will never use your content for marketing without explicit written consent.
7.2 Your Responsibilities
You represent that you own or have necessary rights to all content you upload, including model releases and client permissions. You are responsible for compliance with applicable privacy laws.
7.3 Content Processing
We may process your content (resizing, compressing, transcoding) to optimize delivery. This may include AI-powered optimization to enhance quality and performance across devices.
8. Prohibited Content and Conduct
You may not upload or use the Services for:
- Content you don't have rights to use
- Sexually explicit, pornographic, or obscene material
- Content depicting minors inappropriately
- Hateful, defamatory, or discriminatory content
- Content promoting violence or illegal activities
- Non-photography content (general file storage)
- Personal photos or casual smartphone images
- Malware, viruses, or harmful code
You may not:
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Services
- Reverse engineer or decompile any part of the Services
- Use automated systems to access the Services without permission
- Resell or redistribute access to the Services
- Impersonate others or provide false information
9. Enforcement
Violations may result in:
- First Violation: Warning and content removal
- Repeated Violations: Account suspension
- Severe Violations: Immediate termination without refund
- Illegal Content: Reporting to appropriate authorities
10. Third-Party Services
The Services may integrate with third-party services (payment processors, social media, etc.). Your use of third-party services is governed by their terms and policies. We are not responsible for third-party services or their content.
11. Intellectual Property
The Services, including all software, designs, text, and graphics (excluding your content), are owned by Albumy and protected by intellectual property laws. "Albumy" and our logo are trademarks of Albumy, Inc. You may not use our trademarks without written permission.
12. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALBUMY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
14. Indemnification
You agree to indemnify and hold harmless Albumy and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Services, your content, or your violation of these Terms.
15. Termination
You may terminate your account at any time through your account settings. We may suspend or terminate your account for violations of these Terms or for any reason with notice. Upon termination, your right to use the Services ceases immediately. We recommend downloading your content before termination.
Free accounts inactive for 12 months may be terminated. We will attempt to notify you before deletion.
16. Copyright (DMCA)
We respect intellectual property rights. If you believe content on our platform infringes your copyright, send a notice to [email protected] including:
- Identification of the copyrighted work
- Identification of the infringing material and its location
- Your contact information
- A statement of good faith belief that the use is unauthorized
- A statement under penalty of perjury that the information is accurate
- Your physical or electronic signature
17. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware. You waive any objection to jurisdiction and venue in such courts.
18. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the "Last updated" date. For significant changes, we may also send email notification. Continued use after changes constitutes acceptance.
19. General Provisions
- Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement.
- Severability: If any provision is unenforceable, the remaining provisions remain in effect.
- No Waiver: Failure to enforce any right does not waive that right.
- Assignment: You may not assign these Terms. We may assign them in connection with a merger or acquisition.
